Notice is hereby given in terms of sections 21 and 21A of the Local Government: Municipal Systems Act, 2000 (Act 32 of 2000), that the Council of Cape Agulhas Municipality resolved on 28 May 2026, to introduce development control measures for Struisbaai, L’Agulhas and Suiderstrand in order to manage the allocation of limited municipal water and electricity infrastructure capacity.
Reason: The water resources serving these towns are nearing full allocation. The Municipality’s current planned water projects are needed to accommodate development rights already granted or under consideration, leaving limited capacity for further development. Electricity infrastructure is also constrained by Eskom’s notified maximum demand, particularly during the December and January peak season.
Implementation: The measures will take effect on 11 September 2026 and will remain in force until amended or withdrawn by the Municipal Council. The measures will be reviewed regularly as additional capacity becomes available, and at least annually. Based on current infrastructure planning, sufficient additional capacity to accommodate further development is not anticipated before approximately 2030, subject to infrastructure implementation, funding and regulatory approvals.
Effect: New development applications that increase demand on bulk water or electricity infrastructure will be assessed against confirmed available capacity. Each application will be considered on its own merits and in accordance with applicable legislation. These measures do not revoke, reduce or amend any land-use rights lawfully granted before the effective date.
