INVITATION TO APPLY TO SERVE AS THE EXTERNAL INDEPENDENT CHAIRPERSON OF THE CAPE AGULHAS MUNICIPALITY FRAUD AND RISK MANAGEMENT COMMITTEE (FARMCO)
Cape Agulhas Municipality invites suitably qualified and experienced persons to apply for appointment as the Independent Chairperson of the Fraud and Risk Management Committee (FARMCO) for a period of three (3) years, commencing on a date to be determined by the Municipality.
GOVERNANCE AND LEGISLATIVE MANDATE
FARMCO is an advisory committee established by the Municipal Manager in accordance with the Local Government Risk Management Framework. The successful candidate will provide independent strategic advice and guidance to the Accounting Officer on Enterprise Risk Management, Fraud Prevention, Business Continuity and the risk management contribution to Combined Assurance. This will support the Accounting Officer in fulfilling the responsibilities in terms of the Local Government: Municipal Finance Management Act, 2003 (Act No. 56 of 2003) while recognising the statutory oversight responsibilities of the Audit Committee under section 166 of the MFMA.
KEY RESPONSIBILITIES
MINIMUM REQUIREMENTS
Applicants must possess:
At least eight (8) years’ relevant experience, of which a substantial portion must have been at senior management, executive, specialist or governance-advisory level, in strategic management, risk management and/or Internal/External Auditing,forensic services, governance, or public-sector oversight.

TERM OF APPOINTMENT
The appointment will be for a period of three (3) years. FARMCO meets at least five (5) times per annum. Additional meetings may be convened by the Chairperson or the Accounting Officer as required.
REMUNERATION
Remuneration will be in accordance with the tariffs determined annually by the National Treasury for members of municipal oversight committees. Reimbursement of approved travel and related expenses will be in accordance with the Municipality’s applicable policies and National Treasury guidelines.

- Providing independent leadership to FARMCO and ensuring that the committee fulfils its advisory responsibilities in accordance with its approved Charter.
- Reviewing and advising on the effectiveness of the Municipality’s Enterprise Risk Management, Fraud Prevention and Business Continuity Framework, as well as the risk management contribution to combined assurance.
- Providing guidance on the integration of risk management into the Municipality’s strategic planning, performance management, service delivery, decision-making and reporting processes.
- Leading the Committee in reviewing and making recommendations to the Accounting Officer and where appropriate, the Audit Committee, on the Municipality’s risk management, fraud prevention and business Continuity policies, strategies, implementation plans and related governance documents
- Providing independent advice to the Accounting Officer on significant strategic, operational, fraud, compliance and governance risks affecting the Municipality, together with recommendations to strengthen governance, risk management and internal control.
- Chairing meetings of FARMCO and ensuring that meetings are conducted effectively, objectively and in accordance with its approved Charter.
- Leading FARMCO in fulfilling its responsibilities in accordance with the Local Government Risk Management Framework, the Local Government: Municipal Finance Management Act, 2003 (Act No. 56 of 2003), the approved FARMCO Charter, and the principles of the King V Report on Corporate Governance for South Africa.
- Performing any additional functions assigned to FARMCO in terms of applicable legislation, the Local Government Risk Management Framework, or the approved Charter.
- An appropriate tertiary qualification NQF level 7 or higher in Risk Management, Internal Auditing, Forensic Investigation, Accounting, Finance, Law, Governance or related discipline.
- A relevant postgraduate qualification and/or recognised professional designation will be an advantage
- Proven experience in chairing, or performing a leadership role on a Risk, Audit, Fraud, Ethics or comparable governance committee.
- In-depth knowledge of:
- Applicable local Government legislation
- Local Government Risk Management Frameworks
- Enterprise and fraud risk management, including ISO 31000 and COSO ERM
- Anti-corruption and ethics management standards
- Internal control, internal auditing and combined assurance
- King V and its application within the municipal environment
- Fraud prevention, forensic investigation, anti-corruption and ethics Management
- Business Continuity and organisational resilience
- High ethical standards, independence and professional integrity.
- Strong understanding of municipal governance, fraud risks, service delivery risks and public-sector accountability.
- Advanced analytical and critical-thinking abilities.
- Excellent communication and advisory skills, including the ability to providing clear guidance to the Accounting Officer.
- Ability to facilitate robust discussions, challenge management constructively, and promote sound governance.
- Strong leadership and committee-management skills.
- Ability to maintain independence and exercise sound professional judgement.
- Be a councillor, political office-bearer or employee of Cape Agulhas Municipality.
- Have any conflict of interest that could impair their independence.
- Have been convicted of an offence involving fraud, corruption, dishonesty or financial misconduct.
- Be an unrehabilitated insolvent or otherwise be legally disqualified or legally incapable of serving in the position.
- Be unable to attend in-person Committee meetings and engagements at the Cape Agulhas Municipality’s Head Office in Bredasdorp without incurring excessive travel and subsistence costs. As a general guideline, applicants residing more than 350 km from the Municipality’s Head Office will not be considered, in accordance with the Municipal Cost Containment Regulations, 2019
